Please carefully read this Website User Agreement and Terms of Use (“Agreement”) of SBS Financial Services and its affiliates (“SBS Financial Services,” “we,” “our,” or “us”). This Agreement applies to all visitors and users of the websites owned or controlled by SBS Financial Services (collectively, the “Sites”).

By accessing or using the Sites, you agree to be legally bound by this Agreement, as it may be modified from time to time at the sole discretion of SBS Financial Services. If you do not agree to this Agreement, you are not permitted to use the Sites.

If you choose to proceed to the Online Payment Service, you must also read and specifically agree to the Online Payment Service Terms located at the end of this Agreement.

SBS Financial Services reserves the right, in its sole discretion, to restrict, suspend, or terminate access to all or any part of the Sites at any time, for any reason, without notice or liability. All disclaimers and limitations of liability shall survive termination.

CHANGES TO THE AGREEMENT

We may modify this Agreement at any time. Changes are effective immediately upon posting to the Sites. Your continued use of the Sites after changes are posted constitutes acceptance of those changes.

OUR SERVICES

All services, features, and content on the Sites are subject to change without notice. SBS Financial Services reserves the right to limit or refuse service to any user at any time.

USER REPRESENTATIONS, WARRANTIES, AND COVENANTS

You represent and agree that:

• You will comply with all applicable federal, state, and local laws, including debt collection and payment regulations.
• You will not use the Sites or Online Payment Service for unlawful, abusive, fraudulent, or prohibited purposes.
• You will not copy, reverse engineer, decompile, or misuse any portion of the Sites.
• You will not transmit malware, viruses, or unauthorized access tools.
• If using the Online Payment Service, you will ensure all payment data provided is accurate and authorized.

DISCLAIMER OF WARRANTIES

The Sites and Online Payment Service are provided “AS IS” and “AS AVAILABLE.”

SBS Financial Services makes no warranties, express or implied, including but not limited to accuracy, availability, merchantability, fitness for a particular purpose, or non-infringement.

Your use of the Sites and Online Payment Service is at your sole risk.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, SBS Financial Services, its affiliates, agents, and licensors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

• Use or inability to use the Sites or Online Payment Service
• Payment processing delays or failures
• Errors or omissions in content
• Unauthorized access or system interruptions

If you are dissatisfied, your sole remedy is to discontinue use of the Sites.

PRIVACY POLICY

Any personal information collected through the Sites is governed by our Privacy Policy, which is incorporated into this Agreement by reference.

ELECTRONIC COMMUNICATIONS

Email communications may be insecure. Do not transmit sensitive payment or banking information via email. SBS Financial Services is not responsible for intercepted or misdirected communications.

THIRD-PARTY LINKS

The Sites may contain links to third-party websites. SBS Financial Services is not responsible for the content, security, or practices of third-party sites.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless SBS Financial Services from any claims, damages, losses, or expenses (including attorneys’ fees) arising from your use of the Sites or violation of this Agreement.

GOVERNING LAW AND VENUE

This Agreement shall be governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

Any disputes shall be brought exclusively in the state or federal courts located in Cook County, Illinois. You waive any right to a jury trial.

SEVERABILITY

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

ONLINE PAYMENT SERVICE TERMS

To participate in SBS Financial Services’ Online Payment Service, you must agree to the following additional terms.

THIRD-PARTY PAYMENT PROVIDER

The Online Payment Service is provided by a third-party processor. SBS Financial Services has limited control over the system and limited liability for its operation.

ELIGIBILITY AND AUTHORIZATION

By using the Online Payment Service, you represent that:

• You are 18 years of age or older
• You are legally authorized to use the designated payment account
• All information provided is accurate and complete
• You are responsible for all activity conducted using your payment credentials

PAYMENT AUTHORIZATION

By submitting a payment, you authorize SBS Financial Services and its third-party provider to debit your designated bank account or payment card.

Each payment constitutes a separate authorization.

Late fees, interest, or penalties may still apply if payment is received after the due date, regardless of system availability.

ACCOUNT SECURITY

You are responsible for safeguarding your payment information. Notify SBS Financial Services immediately of any unauthorized use or suspected security breach.

ACKNOWLEDGEMENT

This Agreement constitutes the entire understanding regarding use of the Sites and Online Payment Service. You should print or save a copy for your records.
